General sales conditions

GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions of sale regulate all relations between the company Mondo kids & home LLC and its online customers ("The customer").

Before making any transaction, the customer acknowledges knowing and declares to accept these conditions from the moment they click the Accept button.

1/ Special sales conditions and cancellations

The customer acknowledges knowing at the time of placing the order, the special sales conditions indicated on the screen (name, price components, weight, quantity, color, product details, etc.) and expressly declares to accept them without any reservation. Placing the order and its confirmation by the customer constitutes full and complete acceptance of the special sales conditions, applicable only to the order.

As customizable or made-to-order products, production is carried out upon receipt of the order, and once the production is activated, the order is unique and exclusive to the customer. Therefore, if the customer wishes to cancel an order, they must send their decision to hello@mondokidsandhome.us. If production has not started, we will accept the cancellation.

In cases where returns are accepted due to not meeting the customer's expectations, the customer is responsible for sending the order to our address for verification, and the transportation cost will be borne by the customer.

In the case of murals that require administrative work and mural preparation (design, customization, size adjustment), if the customer wishes to cancel after receiving the first draft, a 25% deduction from the total mural amount will be made to cover the costs of the work performed.

2/ Order

The customer places the order by clicking on the "add to cart and confirm" tab. The order is added to a total that includes all items confirmed by the customer when clicking the "I have read the general terms and conditions of sale and accept them without reservation" button in the order confirmation process.

Mondo Kids & Home's automatic registration systems serve as proof of the nature, content, and date of the order, but a verification of the order will be carried out later to identify any anomalies or errors in the registration. In the event of an error in the registration (computer error, missing data, unrecorded measurements, prices at 0, etc.), the customer will be informed of the incident.

3/ Order confirmation

Our online store automatically sends a confirmation of receipt of the order to the email provided by the customer, detailing the content of the order. In case of detecting any anomaly or if the customer forgets to add any information, they can do so through our email hello@mondokidsandhome.us, indicating their name and order code.

4/ Incidents in the registration

In certain cases, an order may be in a "review" status due to detecting an incident, such as payment issues through the payment gateway (unfinished payment between the customer's bank and Mondo kids & home LLC, also due to any computer error where a product may have a price of 0). In these cases, the customer will be informed, and a joint solution will be sought to confirm the order "without incidents."

There are products in our online store, such as TEXTILE PACKS with a price of 0. When the customer clicks on one or more boxes of desired products, the system calculates the price. If you decide NOT to select any product from the pack and click ADD TO CART, our online store in Shopify allows you to register it as 0, but we inform you that it will NOT BE VALID and will not be accepted.

Our online store DOES NOT GENERATE gift products at a price of 0. Any product with a price of 0 IS NOT VALID. You have marked the box with a click "I agree to the General Terms and Conditions of Sale and accept them unconditionally (read) *", so with this action, you ACCEPT what is indicated in this section of incidents in the registration.

5/ Delivery conditions of orders

The customer will choose the place and date of receipt of the goods when placing the order. Mondo Kids & Home reserves the right to use all necessary means to deliver the products to the address indicated by the customer. In case of changing the delivery address to "other places," the customer must pay for transportation according to our carrier cost conditions by Zone/Country.

6/ Delivery times

All our products can be customized, and therefore, we do not work with stocks. The order is placed when the customer confirms it, and it goes into a work queue. Depending on the type of product, we have an expedition period:

United States and Canada: 15 working days to dispatch the order + 3-5 days for delivery by the carrier.

7/ Shipping company

We currently work with the UPS transport company, but in other instances, we may work with DHL or FedEx.

8/ Delivery and receipt costs

Shipping is free for orders over $150, and for orders below that amount, the cost is $15 to destinations in the USA and Canada continent.

Customs/Duties: This is a data calculated based on the destination country, and you can see it just before confirming the purchase. In the case of countries outside the EU, there may be customs expenses (duties), which will always be borne by the customer according to the customs requirements.

Our factory is located in Spain, and therefore, shipments are considered to have the possibility of customs costs and the application of taxes according to the country. The customer is responsible for paying the taxes applied by their customs.

When placing an order, the customer agrees to sign the receipt presented by the person making the delivery, in which they may include any necessary observations. By signing the receipt, the customer acknowledges having received the number of packages indicated on it.

9/ Price

All prices are indicated in dollars and include VAT. The price invoiced to the customer is the price indicated in the order confirmation sent by Mondo kids & home LLC.

Prices are calculated based on the type of product, measurements, type of finish, and if special customization is desired. The final price can always be viewed before making the payment.

In cases of anomalies in prices indicated or calculated on our online store due to human or computer error, Mondo Kids & Home will inform the customer of the incident. Once the correct price is communicated to the customer, a joint solution will be sought to rectify the error and update the order with the correct data.

9/ Product information

Photographs showing the products are provided for indicative purposes. The texts accompanying these photographs reproduce information found on packaging or usage instructions. Differences between photographs and products can only be minimal and do not affect the essential characteristics of the products. The color of the products shown in the virtual store may differ from the actual color of the product.

In the case of wallpapers and murals, we work to the size indicated by the customer. However, if you have ordered the width of your entire wall, the last strip may have an excess (We work with widths between 100 and 120), so you should cut any excess that may remain, for example, with a ruler and a cutter.

IMPORTANT: On rare occasions, it may happen that the wall where you are going to stick our products is not adequately prepared with a special primer for sticking adhesive or glue-backed products. In these cases, it is important to prepare the wall with a special primer for sticking wallpapers, murals, or products with adhesive on the back.

This can happen due to the type of paint currently on your wall that repels the adhesive or glue, it may be due to dampness on your wall, or even over time, once the product is applied to your wall, stains may appear due to these mentioned reasons.

10/ Incidents and/or claims

We ACCEPT returns in cases of not meeting the established deadline and before entering our production processes, or for receiving a different product than requested or one that has arrived in poor condition.

In case the material arrives damaged due to a carrier incident, reference error, or incorrect customization, or if part of the material is missing, at the time of receiving the order, you have 5 DAYS to notify us by email at hello@mondokidsandhome.us of the reasons (Transport or product reference/design error) and provide a photograph for our quality control department to evaluate the incident.

The color of our products may differ from the color shown on your monitors, and even the color of one of our designs within the same range may differ from another design of the same theme. The main reason is that they are designs that have been HAND-PAINTED, and the artist may have used slightly different tones in one illustration than in another. These reasons are NOT considered for a claim.

We do not accept claims related to the lack of adhesion of our murals, wallpaper, or vinyl on surfaces that are not smooth (walls with textured paint, granulated cement, rough walls, walls with washable paint, or with dampness).

We do not accept claims once the product has been used (textiles) or stuck to the wall unless there is a manufacturing defect. Please check the received order before use, and if you find an error in the design, phrases, names, or other, you must communicate it to hello@mondokidsandhome.us.

Claims accepted by our quality control will be sent back within a maximum period of one week from the acceptance, being sent back at no cost to the customer. It is important to have the defective product within its packaging.

11/ Payment conditions

The requested products will be delivered after payment by credit card (Master Card, Visa Card), through Paypal, or bank transfer.

12/ Privacy Information

Security Mondo Kids & Home LLC is obligated to protect your private information. The personal data collected during your connection to our commercial site will only be used to process your order. We will not sell, rent, or disclose your personal data to anyone (or third parties).

13/ Information requested

When placing orders through the site www.mondokidsandhome.us, you consent to the company Mondo kids & home LLC using nominative data about you, communicated by you or collected through the operation of the site. This data (names, email address, postal address, credit card number with expiration date, etc.) is necessary for us to process your orders.

14/ Security of personal data

Order submissions (which contain information about your account) are made through a secure server. The security program (SSL) encrypts all the information you enter before it is sent to us. In addition, message transmissions are protected against unauthorized access by third parties.

15/ Warranty

The customer will benefit from the legal warranty for hidden defects in the products sold. All our products are designed and manufactured with the utmost care. However, the warranty will not be valid if failures or damages occur due to incorrect handling, lack of maintenance, or care contrary to our instructions for use. The buyer should consult the instructions and appropriate recommendations found in the user manual provided with the product.

In the case of a defective product, the seller must proceed, as appropriate, with the repair, replacement, price reduction, or contract resolution, actions that will be free of charge for the consumer.

The seller is responsible for non-conformities that manifest within a period of 2 years from the delivery. The consumer must inform the seller of the non-conformity within 2 months from becoming aware of it.
